Legal
Revenue Production Management, Inc., does not engage in the practice of law, however, through our association with The Grabowski Law Center, the legal expertise of the partners and associates of that law firm can be made available to any of RPM's clients. The senior members of the Grabowski Law Center have primarily limited their practice to assisting hospitals, physicians and other health care providers in resolving and obtaining reimbursement on health care accounts receivable. The most senior members of the Grabowski Law Center have been representing health care clients for almost twenty years before various state trial, appellate and Supreme Courts as well as before the federal district courts and Courts of Appeal. In addition to providing litigation assistance in collecting delinquent self pay accounts, the law firm's members through litigation and negotiation have sought and obtained changes in state Medicaid laws and procedures, have reversed denied claims from ERISA plans, indemnity insurers, HMO's and PPO's. and have successfully resolved many disputed claims with a variety of other third party payors. Should RPM not be able to successfully obtain reimbursement on an account where our clients are legally entitled to reimbursement, RPM , in writing, will recommend to its client that the account be forwarded to the law firm for resolution. No account is ever forwarded to the law firm without first obtaining a written suit authorization from the client. In requesting such authorization, RPM outlines its rationale for recommending referral to the law firm and identifies sufficient assets to satisfy any judgment if the account is authorized for referral. Should an account require the institution of litigation outside of the area serviced by the Grabowski Law Center, RPM has relationships with attorneys throughout the United States and can recommend referral to attorneys competent to represent our clients' best interests. The Grabowski Law Center and any other attorney RPM recommends are sensitive to the unique issues health care providers face in litigating to collect their accounts receivable. None of the accounts that have ever been referred to the law firm have ever resulted in the foreclosure on an individual's private residence nor their personal vehicle. Wage garnishment and the attachment of bank or brokerage accounts are the primary enforcement vehicles utilized by the law firm to satisfy a judgment. RPM's clients, not RPM nor the law firm, determine how aggressive a stance is taken on collecting an account. In addition to providing litigation services, the attorneys of the Grabowski Law Center are available to our clients to provide educational seminars on health care collections, privacy rules and regulations and negotiating techniques when dealing with outside attorneys. The law firm is also available to assist in contract review and negotiation and to provide general legal advice to RPM's clients on various aspects of health care collections. |
